Terms of Service
by electronic means (donations made through uniters.org.pl)
§1. Definitions
The terms used in these regulations mean:
- “Service” – the online service available at the address: uniters.org.pl
- “Service Provider” – UNITERS Foundation, Klasyków 10A/19, Warsaw 00-661
- “Regulations” – these Regulations
- “User” – an entity that in any way uses the services provided in the Service by the Service Provider and has accepted the Regulations
- “Financial intermediation service” – PayU S.A., payment service provider registered in the business register maintained by the District Court in Poznan – Nowe Miasto and Wilda in Poznan, 8th Commercial Division of the National Court Register under number KRS 0000274399, with a share capital of 4,944,000 PLN fully paid up, having tax identification number NIP: 779-23-08-495, REGON 300523444
- “Donation” – funds transferred by the User to the Service Provider for the implementation of its statutory activities (statutory purposes)
§2. General Provisions
- The purpose of the service is to collect funds for the statutory purposes of the Service Provider.
- Each User is obliged to familiarize themselves with the Regulations before starting to use the Service.
- Using the Service means acceptance and commitment to comply with the rules of the Regulations.
- The Service Provider makes the Regulations available free of charge to Users before concluding an electronic services agreement by placing it on the website.
- The User declares that they understand that transferring a Donation fulfills the conditions of a contract referred to in Article 888 of the Civil Code, i.e., a donation agreement which consists of gratuitous provision to the benefit of the Service Provider at the expense of the User’s assets.
- The User declares that they know that at the moment of making a transfer, conditions referred to in Article 890 § 1 second sentence of the Civil Code are met, which states that a completed donation is valid regardless of the form of legal action.
§3. Conditions for Using the Service

In order for Users to properly use services available in the Service, including effective registration, it is necessary to have:
- a connection to the Internet;
- devices allowing access to Internet resources;
- use of an internet browser capable of displaying hypertext documents linked on the Internet via a web service and supporting JavaScript programming language, as well as accepting cookies files;
- an active email account.
- Meeting some technical requirements specified in §3 section 1 may involve costs, especially obtaining access to the Internet. All costs related to meeting technical requirements are borne by the User.
- Using services provided within the Service is voluntary and free of charge.
§4. Terms of Agreement for the Provision of Services by Electronic Means
- The agreement is concluded at the moment of using the Service.
- Entering into the Agreement is voluntary.
- The Service Provider informs that using the Service involves risks typical for services provided electronically, in particular the possibility of installing malicious software by third parties, password phishing, or other attempts to take control over the User’s identity. At the same time, the Service Provider informs that it has taken all necessary steps to minimize the aforementioned risks.
§5. Services
Under these Terms and Conditions, the Service Provider provides Users with a service enabling, via the financial intermediation Service, the transfer of Donations for statutory purposes of the Service Provider’s activities.
§6. Fees
The Service Provider does not charge Users any commission or other additional fees on Donation payments.
§7. Personal Data
- The data controller of personal data is the Service Provider.
- Providing personal data is voluntary but necessary if the User decides to make a Donation through the Service, to the extent required to transfer the Donation for statutory purposes.

Data will be processed for establishing contact after making a donation, fulfilling legal obligations, and executing the agreement or taking steps prior to its conclusion. The legal basis for data processing is Article 6(1)(b), (c), and (f) of Regulation (EU) 2016/679 of the European Parliament and Council dated April 27, 2016, on protecting natural persons regarding personal data processing and free movement of such data—i.e., performance of a contract or actions prior to its conclusion at the request of the data subject, fulfillment of a legal obligation imposed on the data controller, and legitimate interest of the data controller consisting in contacting donors to express thanks for donations and pursue potential claims. For this purpose, we process the following data:
- User’s first name, last name, and email address;
- Data provided by the financial intermediation Service to the Service Provider related to payment of Donation amount to the Service Provider’s account;
- Address details (if provided by User).
- This data will not be shared with other entities.
- Data will be stored for 5 years (the statutory period for tax limitation). After this time, they may be processed for the period of limitation of claims or as specified in separate legal provisions.
- Data will not be transferred outside the European Economic Area or to an international organization.
- You have the right to access your personal data, correct it, delete it, or restrict its processing, as well as the right to object to further processing.
- The Administrator informs that your data is not processed in a way that leads to automated decision-making, including profiling.
- You have the right to file a complaint with the supervisory authority: President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw.
§8. Complaints
- Every User has the right to file a complaint regarding matters related to the operation of the Service and the performance of services by the Service Provider.
- Complaints should be submitted electronically via email to: v.batryn@gmail.com or in writing to the Service Provider’s address.
- The Service Provider will respond to the complaint within 14 days from the date of its receipt.
- The response to the complaint will be sent to the User at the email address provided in the complaint or, if the complaint was submitted in writing, to the email address indicated in the letter.
- The Service Provider informs that complaints regarding services provided electronically by third parties, which are accessed through Users’ use of the Service, including financial intermediation services provided by the Service, are handled by those third parties according to their own terms and procedures specified in their service regulations.
- The Service Provider is not responsible for the operation of financial intermediation services.
- The Service Provider informs that at http://ec.europa.eu/consumers/odr there is an online platform for out-of-court dispute resolution between consumers and entrepreneurs (ODR platform), which may be used by the Service Recipient.
§9. Data Deletion, Termination and Dissolution of Agreement
- The User has the right to request deletion of their data from the Service Provider by sending an email containing such a request from the address provided during registration on the Service, and the Service Provider is obliged to delete such data immediately upon receiving such a request.
- A request for data deletion is equivalent to submitting a statement terminating the agreement binding the User with the Service Provider.
- The agreement is terminated upon receipt by the Service Provider of the request referred to in paragraph 1.
- The Service Provider may terminate the agreement with the User and delete their data if the User violates these Terms or breaches generally applicable laws in connection with using the Service.
- The User will be informed about termination of the agreement under §9 paragraph 4 via an email sent to the electronic mail address provided by filling out a form on the Service.
§10. Changes to Terms
- The Service Provider reserves the right to make changes to these Terms.
- All changes to these Terms will take effect from their posting on the foundation’s website.
§11.Final Provisions
- The Terms and Conditions are effective from the date of their publication on the Service’s website.
- The Terms and Conditions are available on the Service’s website in a format that allows for playback and recording, as well as at the Service Provider’s headquarters.
